Terms of Service, Donation Policy, and Stream Interaction Rules

1. Payments Are Voluntary Contributions

All payments made through this page are voluntary contributions to support Erby, the stream, and the entertainment content being created.

Some payments may trigger or request interactive stream events, alerts, redeems, challenges, media, text-to-speech, timer changes, printed images, trip routes, menu items, or other on-stream actions. These interactions are part of a live entertainment experience. They are not guaranteed products, guaranteed services, guaranteed deliverables, or guaranteed purchases.

You are choosing to support the stream. You are not guaranteed any specific outcome.

3. Requests Are Not Guaranteed

Erby will make a good-faith effort to fulfill reasonable requests when possible, but nothing submitted through this page is guaranteed.

Requests may be completed, delayed, modified, shortened, skipped, declined, canceled, substituted, refunded at Erby's sole discretion, ignored, or removed from the queue for any reason, including but not limited to:

• Technical problems, website errors, browser issues, bot or API failures, or overlay issues.
• Payment processor errors, disputes, reversals, holds, or failed payment processing.
• Stream crashes, internet outages, power outages, printer failures, audio problems, or video playback problems.
• Platform moderation issues or restrictions from Twitch, YouTube, Kick, TikTok, Instagram, PayPal, or other third-party services.
• Safety concerns, health concerns, travel issues, weather, vehicle issues, closed locations, unavailable locations, private property, or illegal requests.
• Harassment, doxxing, NSFW content, hate speech, threats, spam, fraud, abuse, common sense, or anything Erby decides is not appropriate for the stream.

Erby has final discretion over what happens on stream.

4. Live Content Is Unpredictable

This page is connected to a live stream. Live content is unpredictable, and things may not always work as expected.

• Streams can crash, alerts can fail, videos can fail to load, and TTS can fail to generate.
• Printers can jam or disconnect, APIs can break, websites can go offline, and internet connections can drop.
• Payment processors can delay or reject payments, and stream rules may change during the stream.
• Erby may need to stop, pause, delay, or change plans at any time.

A technical problem, stream problem, mistake, delay, bug, outage, or failed request does not automatically entitle you to a refund.

5. Creator Discretion

Erby may accept, decline, modify, delay, skip, remove, or stop any request at any time for any reason.

This includes requests that are unsafe, illegal, inappropriate, impossible, unavailable, too disruptive, against platform rules, against payment processor rules, harmful to the stream, harmful to Erby, harmful to others, or not in the spirit of the content.

Erby may also reject requests simply because they do not fit the stream, the moment, the current challenge, the current rules, the current location, or the current situation.

6. Platform Rules Still Apply

All requests must follow the rules and terms of any platforms involved, including but not limited to Twitch, YouTube, Kick, TikTok, Instagram, PayPal, Venmo, Apple Pay, Google Pay, credit card networks, debit card networks, and any other services used by this page or the stream.

If a request would violate platform rules, payment processor rules, law, safety standards, or moderation policies, it may be skipped, removed, declined, modified, or ignored without refund.

7. Payment Processors and Third-Party Services

Payments may be processed through PayPal, Venmo, credit cards, debit cards, Apple Pay, Google Pay, or other third-party payment processors.

By paying through this page, you also agree to the rules, terms, and policies of the payment processor or payment method you use.

Erby does not control PayPal, Venmo, Apple Pay, Google Pay, your bank, your card issuer, or any third-party payment service. Payment processors may make their own decisions about disputes, reversals, limitations, holds, fees, claims, chargebacks, fraud reviews, and account actions.

Submitting a payment through this page does not override the payment processor's own rules.

9. Age and Permission

You must be legally allowed to use the payment method you are using.

If you are under the age required to make payments in your area, or if you are using a parent's, guardian's, friend's, family member's, employer's, or any other person's payment method, you must have permission before paying.

Do not donate or submit payments using a payment method you are not authorized to use.

Unauthorized payments, stolen payment methods, fraudulent payments, or payments made without permission may result in bans, reports, disputes, and account restrictions.

10. Menu Items and Redeems

The Menu tab may allow users to submit payments for stream redeems, challenges, actions, activities, food items, punishments, goals, tasks, or other interactive content.

Menu items are stream interaction requests. They are not guaranteed purchases.

Menu items may be delayed, modified, declined, skipped, combined, substituted, canceled, or completed differently than originally described depending on the stream, safety, availability, timing, platform rules, real-world conditions, or Erby's discretion.

Examples of reasons a menu item may not be completed exactly as submitted include:

• The item is unsafe, unavailable, illegal, physically impossible, inappropriate, or violates platform rules.
• The item requires travel that is not possible or would interrupt something important.
• The item would harm the stream, Erby, or someone else.
• The item is no longer relevant by the time it comes up, was submitted incorrectly, or was based on a misunderstanding.

Erby will generally try to complete reasonable menu items when possible, but completion is not guaranteed and refunds are not guaranteed.

11. Media Share

The Media Share tab may allow users to submit links or media from platforms such as YouTube, TikTok, Instagram, or other supported services.

Media Share requests are not guaranteed to play.

Media may be skipped, stopped, muted, shortened, delayed, rejected, blocked, or removed without refund if the media:

• Fails to load, is deleted, unavailable, region-blocked, age-restricted, copyright-blocked, muted, or blocked by the platform.
• Contains NSFW content, hateful content, harassment, threats, doxxing, gore, illegal content, scams, or spam.
• Violates platform rules, is too loud, is disruptive, is unsafe for stream, is not appropriate for the current stream, is rejected by moderation, or is blocked by Erby.

You are responsible for the links you submit.

A video failing to load, being skipped, being moderated, being unavailable, or being blocked does not automatically entitle you to a refund.

12. Text-to-Speech

The TTS tab may allow users to pay for messages to be read aloud using selected voices.

TTS messages may be skipped, edited, censored, shortened, delayed, rejected, or not played without refund if they contain or appear to contain:

• Slurs, hate speech, harassment, sexual content, NSFW content, doxxing, private information, or threats.
• Spam, scams, impersonation, excessive repetition, platform rule violations, attempts to trick the TTS system, or content that Erby does not want read on stream.

TTS voices may fail, sound different than expected, become unavailable, generate incorrectly, mispronounce words, or fail to play. These issues do not automatically entitle you to a refund.

13. Timer and Subathon Features

The Timer tab may allow users to add time to a countdown timer or affect stream duration.

Adding time to a timer is a voluntary contribution and is not a guarantee that the stream will continue under all circumstances.

Timers may be paused, adjusted, capped, reduced, stopped, ended, modified, or overridden at Erby's discretion.

Reasons may include:

• Health and safety, sleep, emergencies, unsafe conditions, real-world obligations, or common sense.
• Platform issues, technical problems, internet outages, power outages, stream crashes, account suspensions, moderation concerns, or rule changes.

Timer payments are final and non-refundable.

14. Map, Route, Location, and Trip Requests

The Map tab may allow users to submit locations, routes, destinations, trips, stops, or travel-related requests.

Map, route, location, and trip payments are stream interaction requests. They are not guaranteed travel contracts.

Submitting a location or route does not guarantee that Erby will go there, arrive there, enter the location, complete the route, complete the trip, stream the trip, or do anything specific at the destination.

Erby may decline, modify, reroute, delay, cancel, skip, shorten, or substitute any location or route for any reason, including but not limited to:

• Safety concerns, dangerous areas, bad weather, vehicle issues, charging issues, fuel issues, road closures, traffic, police activity, emergencies, fatigue, or health concerns.
• Closed businesses, private property, restricted areas, illegal destinations, schools, hospitals, private homes, government buildings, harassment risks, doxxing risks, stalking risks, platform rules, distance or cost changes, common sense, or anything Erby decides is not appropriate.

Do not submit private residences, doxxing targets, harassment targets, unsafe locations, illegal locations, restricted locations, or locations intended to endanger, stalk, harass, embarrass, or harm anyone.

Trip requests are subject to real-world conditions and Erby's final discretion. No route, stop, destination, arrival time, travel time, travel outcome, or on-stream activity is guaranteed.

15. Print Requests

The Print tab may allow users to submit images to be printed on stream when the print system is available.

Print requests are not guaranteed.

Images may be rejected, skipped, edited, cropped, delayed, blocked, or not printed without refund if they contain or appear to contain:

• NSFW content, nudity, sexual content, illegal content, hate speech, harassment, doxxing, private information, threats, or gore.
• Copyright-problematic content, spam, scams, platform rule violations, or anything Erby does not want printed.

Printer issues may happen. This includes paper jams, low ink, bad print quality, app disconnects, Wi-Fi issues, printer offline status, failed uploads, file errors, broken image links, wrong sizing, cropping issues, color differences, or physical printer failure.

A failed, delayed, low-quality, cropped, or rejected print does not automatically entitle you to a refund.

16. Alerts and Overlay Effects

Payments may trigger alerts, animations, sounds, graphics, overlays, leaderboard updates, chat messages, on-screen events, or other stream effects.

Alerts and overlay effects are not guaranteed.

An alert may fail, be delayed, appear incorrectly, not appear, play without sound, duplicate, be hidden, be skipped, or be removed due to technical issues, moderation, platform rules, stream layout changes, or Erby's discretion.

A failed or incorrect alert does not automatically entitle you to a refund.

17. Future Features and New Tabs

This website may add new tabs, features, redeems, games, wheels, bounties, goals, missions, challenges, alerts, leaderboards, auctions, polls, votes, rewards, punishments, physical tasks, digital interactions, real-world activities, travel features, stream controls, or other forms of interactive content in the future.

Unless a future feature has its own separate written rules, these Terms apply to all current and future features.

Future features are also voluntary stream interaction requests and are not guaranteed products, guaranteed services, or guaranteed deliverables.

Erby may change, remove, pause, disable, modify, replace, or discontinue any feature at any time.

18. User-Submitted Content

You are responsible for anything you submit through this page, including names, messages, links, images, locations, routes, media, text-to-speech messages, usernames, and any other content.

By submitting content, you confirm that you have the right to submit it and that it does not violate the law, platform rules, payment processor rules, or these Terms.

You agree not to submit content that includes:

• Doxxing, private information, harassment, threats, hate speech, slurs, illegal content, NSFW content, sexual content involving minors, or gore.
• Scams, malware, phishing, impersonation, stolen content, copyright-infringing content, content designed to get Erby banned, content designed to harm another person, or content designed to abuse the stream or payment system.

Erby may remove or reject any user-submitted content at any time.

19. Permission to Use Submitted Content

By submitting content through this page, you give Erby permission to display, play, read, print, discuss, react to, record, save, stream, repost, clip, edit, transform, moderate, or otherwise use that content as part of the stream, videos, social media, archives, highlights, promotional content, or related creator content.

This permission is worldwide, non-exclusive, royalty-free, and does not require additional payment to you.

Submitting content does not give you ownership over the stream, video, clip, reaction, recording, or content created by Erby.

20. Moderation and Bans

Erby may ban, block, restrict, blacklist, mute, remove, or ignore any user for any reason, including but not limited to:

• Abusive behavior, harassment, fraud, chargeback abuse, payment abuse, spam, trolling, doxxing, threats, platform rule violations, or unsafe requests.
• Repeated rejected requests, attempts to get the stream banned, attempts to exploit the website, or attempts to bypass moderation.

Being banned, blocked, muted, restricted, or removed does not entitle you to a refund.

21. Pricing, Mistakes, and Changes

Prices, rates, timers, menu items, trip pricing, media pricing, TTS pricing, print pricing, goals, multipliers, discounts, minimums, maximums, and feature rules may change at any time.

If the website displays an incorrect price, incorrect description, incorrect timer amount, incorrect media duration, incorrect route price, incorrect item, incorrect calculation, or incorrect feature behavior due to a bug, typo, exploit, or technical issue, Erby may correct, cancel, modify, or decline the request without refund.

Erby is not required to honor obvious mistakes, exploits, glitches, broken pricing, or unintended behavior.

22. Availability

This website and its features may be unavailable, disabled, paused, under maintenance, broken, limited, or changed at any time.

Some features may only be available during certain streams, at certain locations, when certain apps are running, when certain devices are online, or when Erby chooses to enable them.

For example, print requests may only work when Erby is home, the printer is connected, the printer app is running, and the print system is enabled.

Feature availability is not guaranteed.

23. No Warranties

This website, the stream, and all related features are provided as-is and as-available.

Erby does not guarantee that:

• The website will always work, the stream will always stay live, payments will always process correctly, or requests will always be completed.
• Alerts will always appear, media will always play, TTS will always work, prints will always print, routes will always be completed, or timers will always continue.
• Features will always remain available or third-party services will always work.

Use this page at your own risk.

24. Limitation of Liability

To the maximum extent allowed by law, Erby is not responsible for indirect, incidental, special, consequential, punitive, or unexpected damages related to your use of this website, the stream, third-party services, payment processors, submitted content, failed requests, delayed requests, skipped requests, technical issues, or any other issue related to this page.

If any liability exists, it is limited to the amount you paid for the specific transaction at issue, unless otherwise required by law.

25. No Emergency, Safety, or Essential Services

This website is for entertainment purposes only.

Do not use this page for emergencies, urgent messages, safety-critical information, medical issues, legal issues, threats, crisis situations, or anything requiring immediate attention.

Messages, requests, donations, TTS, media, prints, or other submissions may not be seen or responded to immediately.

26. Privacy and Logs

Erby may collect and store information related to payments, requests, submissions, moderation, disputes, fraud prevention, and website functionality.

This may include:

• Display name, username, submitted name, submitted message, submitted links, submitted media, submitted images, and submitted locations.
• Payment amount, payment status, payment method type, transaction ID, time and date, request type, fulfillment status, and moderation notes.
• Technical logs, IP address, or device/browser information where applicable.

This information may be used for stream functionality, moderation, fraud prevention, dispute evidence, chargeback evidence, support, analytics, and site improvement.

Do not submit information you do not want associated with the stream or your request.

27. Third-Party Content and Links

This page may use, display, embed, link to, or interact with third-party platforms and content, including but not limited to YouTube, TikTok, Instagram, Twitch, Kick, PayPal, Venmo, Google, Apple, map services, payment processors, APIs, bots, overlays, and other services.

Erby does not control third-party services and is not responsible for their availability, content, moderation decisions, errors, outages, restrictions, fees, terms, or policies.

Your use of third-party services is subject to their own terms and rules.

28. Chargebacks, Disputes, and Evidence

If you open a dispute, claim, chargeback, bank reversal, or payment processor complaint, Erby may provide evidence showing the nature of the payment and your interaction with the website.

Evidence may include:

• These Terms, the version of the Terms active at the time of payment, website logs, request logs, payment logs, and transaction records.
• Chat logs, stream recordings, screenshots, overlay logs, moderation logs, proof of request fulfillment, proof of attempted fulfillment, proof that a request was rejected under these Terms, and proof that the payment was voluntary.

By using this page, you understand that your request and payment activity may be documented for dispute prevention and dispute response.

29. Changes to These Terms

Erby may update, change, replace, or modify these Terms at any time.

The current version of the Terms will be posted on this page or made available through the website.

By continuing to use the website after the Terms are updated, you agree to the updated Terms.

For dispute and recordkeeping purposes, Erby may store the Terms version that was active when a payment or request was submitted.
